Terms & Conditions

These terms govern the use of the Budi Advocates website and the basis on which we provide legal services. Please read them carefully. Using this website or instructing us on a matter means you accept these terms. If any part is unclear, please contact us before proceeding.

1. About Budi Advocates

Budi Advocates is a law firm in Malaysia, practising under the Legal Profession Act 1976. Our principal office is at Level 3, Menara Hatten, Jalan Merdeka, 75000 Melaka. We are regulated by the Malaysian Bar. Our lawyers hold current practising certificates issued by the Bar Council of Malaysia.

2. This Website

The content on this website is provided for general information about our firm and the services we offer. Nothing on this website constitutes legal advice, and no solicitor-client relationship is formed by browsing these pages or submitting an enquiry through the contact form.

We make reasonable efforts to keep information current and accurate, but we do not warrant that it is complete, up to date, or free from error. Law and regulatory guidance changes; we recommend you speak with us directly rather than relying solely on content found here.

3. Our Legal Services

We offer the following fixed-fee services to consumers in Malaysia:

A formal engagement letter confirming scope, fees, and terms is provided before work begins on any matter. Fees stated above are inclusive of professional fees only; disbursements (court filing fees, service charges, TCCM registration fees, courier costs, and similar out-of-pocket expenses) are charged separately and itemised.

4. How an Engagement Begins

A solicitor-client relationship is formed only when:

  1. We have confirmed in writing that we are able to act for you on a particular matter;
  2. You have signed and returned our engagement letter; and
  3. The agreed fee (or agreed first instalment) has been received.

Sending an enquiry through our website contact form, calling our office, or attending a consultation does not by itself create an engagement. We will tell you clearly when we are formally acting for you.

5. Payment

Payment is due as set out in the engagement letter. We accept bank transfer and cash at our office. Receipts are issued for all payments. Fees paid for work already performed are non-refundable unless we have agreed otherwise in writing or unless there has been a failure of service on our part. We do not hold client money in escrow for matters within the TCCM's jurisdiction; all fees are for professional services rendered.

6. Confidentiality

Information you share with us in connection with a matter is treated as confidential under Malaysian legal professional privilege and our obligations under the Legal Profession Act 1976 and the Legal Profession (Practice and Etiquette) Rules 1978. We will not disclose your information to third parties except as required by law, with your consent, or where necessary to carry out your instructions (for example, filing with the TCCM or submitting correspondence to the opposing party).

7. Conflicts of Interest

Before accepting a new matter, we conduct a conflict check. If a conflict arises after an engagement has begun, we will notify you promptly and advise on appropriate next steps, which may include referring you to another suitable firm.

8. Limitations on Liability

Our liability to you in connection with any matter is limited to direct loss arising from our negligence or breach of duty. We do not exclude liability where to do so is prohibited by law, including under the Consumer Protection Act 1999 and the Legal Profession Act 1976. We maintain professional indemnity insurance as required by the Malaysian Bar.

We are not responsible for outcomes at the TCCM or in court. Tribunal and court decisions depend on many factors, including the conduct of the other party, the presiding officer's assessment of evidence, and legal submissions. We will advise you as clearly as we can on the likely range of outcomes, but we cannot and do not warrant any particular result.

9. Termination of Engagement

By you

You may end an engagement at any time by notifying us in writing. You will be responsible for fees for work completed up to the date we receive notice. We will provide a final statement of account within 14 days.

By us

We may cease acting if there is a breakdown in the professional relationship, if instructions require us to act contrary to our professional obligations, if fees are not paid in accordance with the engagement letter, or if a conflict of interest arises that cannot be managed. We will give reasonable notice and assist with the transfer of your file to a new adviser.

10. Complaints

If you are dissatisfied with any aspect of our service, please write to us at [email protected]. We will acknowledge your complaint within three working days and provide a substantive response within 21 days. If you remain dissatisfied after our internal process, you may refer the matter to the Malaysian Bar's Complaints Committee.

11. Intellectual Property

All content on this website — including text, layout, and the template letters available for download — is the intellectual property of Budi Advocates or its licensors. The template letters are offered for personal, non-commercial use. You may adapt them for your own consumer matter. You may not reproduce, sell, or redistribute website content without our written permission.

12. Third-Party Links

This website may link to external resources, including the TCCM's portal, the Malaysian Bar's website, and relevant government agencies. We do not control these sites and are not responsible for their content or availability.

13. Governing Law

These terms are governed by the laws of Malaysia. Any dispute arising from these terms or from our engagement will be subject to the jurisdiction of the courts of Malaysia, with Melaka as the preferred venue unless otherwise agreed.

14. Changes to These Terms

We may update these terms from time to time. The version published on this website at the date you instruct us governs that engagement. Material changes will be reflected in the "Last Updated" date above.
