Case Study 01

Defective motorcycle and a dealer refusing warranty service

The situation

A client in Melaka purchased a motorcycle that developed engine faults within five months. The dealer claimed the fault was caused by user error and declined warranty service. The client had no knowledge of how to dispute this formally.

What we did

We reviewed the purchase documents, the dealer's written refusal, and an independent workshop report obtained by the client. We issued a letter of demand setting out the consumer's rights under the CPA 1999, the specific defect timeline, and a 14-day response deadline.

The outcome

The dealer agreed to carry out the warranty repair within 10 days of receiving the letter. No tribunal filing was necessary. Total duration from first consultation to resolution: 5 weeks.

Case Study 02

Group of tenants — shared complaint about landlord-supplied appliances

The situation

Seven tenants in a serviced apartment complex contacted us after a property management company refused to replace defective air-conditioning units, pointing to lease terms that they claimed excluded them from liability.

What we did

We reviewed the lease terms, assessed whether the exclusion clause was enforceable under Malaysian consumer law, and advised the group on a coordinated approach — individual letters of demand and parallel TCCM filings where appropriate.

The outcome

Four of the seven matters settled after letters were sent. Three proceeded to TCCM; two were awarded replacement costs. The third was settled at the pre-hearing mediation stage. All matters concluded within four months.

Case Study 03

Online electronics seller — product misrepresented in listing

The situation

A client paid RM 1,900 for a camera that, on arrival, was a different model from what was listed. The platform's dispute process had been exhausted and the seller was unresponsive. The client had screenshots of the original listing.

What we did

We advised the client to file with the TCCM on the basis of misrepresentation under the CPA 1999. We drafted Form 1, assembled the listing screenshots, payment records, and correspondence as evidence, and prepared the client for the hearing.

The outcome

The tribunal awarded the full RM 1,900 plus filing fees. The seller paid within the award period. Total duration from first consultation to award payment: approximately 14 weeks.
